Illinois man arrested for OVWI after trooper finds him along I-69

A roadside welfare check turned into an operating while intoxicated arrest June 15 after an Indiana State Trooper found a man reportedly urinating on the shoulder of Interstate 69 and later determined him to be highly intoxicated.

According to a probable cause affidavit filed in Greene County Superior Court, Indiana State Police Trooper Tyler Trueblood was dispatched around 5:27 p.m. to a car-deer crash near the 104-mile marker. While en route, he observed a red Toyota sedan pulled over near the 98-99 mile marker with flashers on and a man standing between the car and the guardrail.

Trueblood noticed the man — later identified as Justin M. Lind, 37, of Marion, Ill. — appeared to be urinating. Shortly afterward, ISP dispatch reported a red vehicle driving erratically in the same area. Believing it could be related, according to the probable cause affidavit, Trueblood returned to check on the vehicle, which matched the description provided in the dispatch report.

Upon approaching the car, Trueblood noted Lind had red, glassy eyes, slurred speech, and smelled strongly of alcohol. Lind told the trooper he was alone and headed home after stopping to relieve himself. He admitted to drinking “two beers.”

Lind agreed to undergo field sobriety tests but struggled with balance, swayed, stepped off the line, used his arms for balance, and showed multiple signs of impairment during standardized tests, according to the probable cause affidavit. 

A preliminary breath test (PBT) revealed a blood alcohol concentration of .315, nearly four times the legal limit.

Trueblood read implied consent to Lind, who agreed to a certified chemical test. He was transported to Monroe County Hospital for a blood draw and medical clearance due to his level of intoxication. His blood was drawn at 7 p.m. and later submitted to the Indiana Department of Toxicology for analysis.

Lind’s vehicle was inventoried and towed from the scene. He was then transported to the Greene County Jail without further incident.

Lind faces a charge of operating a vehicle while intoxicated, a Class A Misdemeanor. He is scheduled to appear in Greene Superior Court on June 26.
